No More Waitlists is not a healthcare provider and does not provide medical advice, diagnosis, treatment, healthcare services, or medical opinions.

Any healthcare services are provided solely by independent healthcare providers and not by No More Waitlists.

ELIGIBILITY

You must be at least 18 years of age to use the Website.

By using the Website, you represent and warrant that:

  • You have the legal capacity to enter into these Terms;

  • All information you provide is accurate and current; and

  • Your use of the Website complies with all applicable laws.

Providers remain solely responsible for their listings and the accuracy of all content.

No More Waitlists does not guarantee the accuracy, completeness, or timeliness of listing information.

REVIEWS AND USER CONTENT

Users may submit reviews, ratings, comments, and other content.

By submitting content, you grant No More Waitlists a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, publish, display, distribute, modify, and promote such content in connection with operating and marketing the Website.

You agree not to submit content that:

  • Is false or misleading;

  • Is defamatory or harassing;

  • Violates privacy rights;

  • Infringes intellectual property rights;

  • Contains unlawful material;

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NO MORE WAITLISTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE WEBSITE SHALL NOT EXCEED THE GREATER OF:

(A) ONE HUNDRED CANADIAN DOLLARS (CAD $100); OR

(B) THE AMOUNT PAID BY YOU TO NO MORE WAITLISTS DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless No More Waitlists and its officers, directors, employees, contractors, affiliates, and representatives from claims, liabilities, damages, losses, costs, and expenses arising from:

  • Your use of the Website;

  • Your content;

  • Your provider listing;

  • Your violation of these Terms; or

  • Your violation of any law or third-party rights.

TERMINATION

We may suspend, restrict, or terminate access to the Website at any time, with or without notice, for any reason.

Termination does not affect obligations that by their nature survive termination.

GOVERNING LAW

These Terms shall be governed by and interpreted under the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

DISPUTE RESOLUTION

Before commencing legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiations.

Any dispute arising from these Terms shall be brought exclusively before the courts located in Ontario, Canada.

CLASS ACTION WAIVER

To the fullest extent permitted by law, you agree that any claim shall be brought solely in your individual capacity and not as a plaintiff or class member in any class, representative, collective, or similar proceeding.
